While the change does not take effect until April, now is the right time to review your hiring practices and prepare.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-new-york-employment-credit-check-restrictions\">\ud83d\udea8 <strong>New York Employment Credit Check Restrictions<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Effective April 18, 2026<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">New York State has enacted a significant change to its employment screening laws that restricts the use of <strong>consumer credit history<\/strong> in hiring decisions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On <strong>December 19, 2025<\/strong>, Governor Kathy Hochul signed <strong>Bill S03072<\/strong> into law, amending the New York State Fair Credit Reporting Act. Beginning <strong>April 18, 2026<\/strong>, employers across New York State will generally <strong>no longer be permitted to request or rely on an applicant\u2019s or employee\u2019s consumer credit history<\/strong> when making employment-related decisions \u2014 except in limited, legally defined circumstances.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This change expands protections that previously applied mainly within <strong>New York City<\/strong> to employers <strong>statewide<\/strong>.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-how-this-impacts-background-screening\">\ud83d\udd0d <strong>How This Impacts Background Screening<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The new law affects both employers and background screening providers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Starting April 18, 2026:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Employers may not use consumer credit history for New York-based positions unless a statutory exemption applies<\/li>\n\n\n\n<li>Consumer Reporting Agencies (CRAs) may not provide employment credit reports for New York positions unless an exemption is validated<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Credit reports will only be available <strong>where use is legally required or expressly permitted by law<\/strong>.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-limited-role-specific-exceptions\">\u26a0\ufe0f <strong>Limited, Role-Specific Exceptions<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The law includes <strong>narrow exemptions<\/strong>, which may apply to certain roles, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Regulated financial positions<\/li>\n\n\n\n<li>Law enforcement roles<\/li>\n\n\n\n<li>Positions requiring bonding or security clearance<\/li>\n\n\n\n<li>Other specifically defined fiduciary or security-sensitive roles<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Exemptions are <strong>role-specific<\/strong>, not employer-wide.
